Teacher Policy

In order to offer Teacher Services on the Learner’s Classroom Platform, you must agree to these policies for Teachers ("Teacher Policy")

If you do not accept this Teacher Policy in full, you are not authorized to teach on the Learner’s Classroom Platform and you are not eligible to receive any benefits from Learner’s Classroom for any Teacher Services you provide.

This Teacher Policy is designed to encourage the highest standards of Teacher behaviour in their relationships with Students by setting clear expectations, and to provide the principles to guide Teachers in their daily conduct when providing Teacher Services and interacting with Students.

This Teacher Policy does not attempt to address every potential situation that could arise when Teachers interact with Students on the Learner’s Classroom Platform, but instead provides principles for ethical and professional behaviour that can serve as guidance regarding Learner’s Classroom expectations.

 

1. Teacher Registration and Service Description

1.1 Teacher Registration

In order to become a "Teacher", you must first submit a complete application form available on Learner’s Classroom website. Your completed Teacher Application will be evaluated by Learner’s Classroom for approval. All teachers are required to complete their contractual agreement with Learner’s Classroom at the time of registration.

To the extent permitted by applicable law, Learner’s Classroom may obtain background check reports from public records or through third party vendors. As a condition of applying to become a Teacher, you agree and authorize us to use your personal information, such as your full name and date of birth, to obtain such reports. In order to obtain such identity verification check reports, you further agree and authorize us to provide a copy of the official identification card.

1.2 Teacher Services Description and demo classes

All Teachers must create a description and agree to a demo class of their courses at the Learner’s Classroom Platform. When creating the description / conducting the demo class, you agree to the following:

  1. Write a specific, detailed service description with clear teaching scope and Lessons;

  2. Set expectations that you can meet or exceed;

  3. Do not offer services with the intent to commit fraud, provide services other than those outlined in your description, or offer any services in exchange for positive feedback or at no cost;

  4. Do not advertise any third-party teaching service, platform, software, or application; and

  5. Do not include any personal contact information, including but not limited to, email, telephone number, or social media account number.

2. Teacher Services Guidelines

2.1 Teacher Service Request

Once you receive a Teacher Service request from a Student, you agree to the following:

  1. Use the Learner’s Classroom Platform to manage all Teacher Service requests from Students;

  2. Respond on time and promptly to all Teacher Services related communications, whether from a Student or from Learner’s Classroom;

  3. Maintain a record of all important details of the communication between you and the Student. For their avoidance of doubt, communication may be conducted via Learner’s Classroom platform messenger or in-person conversations during the demo class on Learner’s Classroom platform, and important details generally includes information related to the scope of your Teacher Services, your time frames and availability to provide any Teacher Service, your price, your feedback to Student, any schedule changes, any delay of providing your Teacher Service, and completion of Lessons; and

2.2 Lesson Policy

All Teachers are expected to comply with the following policies when providing a Lesson:

  1. Commit to your scheduled Lesson. A confirmed Lesson is a commitment you make with a Student. Reschedule or cancel as a last resort and only after you have communicated this with your Student. If you know you will be away and unable to respond to Students for a certain period, take the responsibility to notify your Students of your absence and update the availability information on your Learner’s Classroom Account profile accordingly. Once the teacher accepts the student in the course, the teacher is obligated to complete the entire course in the stipulated time with the exception of any emergency circumstances.

  2. Make records. Teachers should maintain a record of all important details of communications with the Students pursuant to Section 2.1(3). If there is a dispute between Teacher and Student, Learner’s Classroom will request both Teacher and Student to provide evidence in the format of screenshots, and such screenshots shall contain all information related to such dispute, such as the date, time and other communication details.

  3. Start Teacher Services on time. Teachers should start any Lesson at the time scheduled with the Student, and should initiate contact with the Student, particularly with a first-time Student.

  4. Connect with the Student. Teachers should connect with their Students on the Learner’s Classroom communication platform well before the scheduled start time for the Lesson. Don’t wait until the last minute.

  5. Waiting for a late Student. If a Student is late for a scheduled Lesson, the Teacher should wait for the Student until the end of the period for the scheduled Lesson. The Teacher should be available to start the Lesson at any time during the scheduled period for the Lesson. The Teacher is not, however, required to make up for lost time due to the Student's late arrival.

  6. End Lesson on time. Teachers should politely let Students know that their lessons are ending by reminding them before the end of the Lesson time period. You may politely tell the Student that you need to prepare for an upcoming Lesson with another Student.

  7. Rescheduling a Lesson due to Student’s absence. If a Student fails to attend a Lesson and requests to reschedule the class, it is the Teacher decision to agree or reject. In-case the student provides advance notice for cancellation of the class; the teacher is obligated to reschedule the class.

2.3 Cancellation and Rescheduling

If you will be unable to provide your Teacher Services at the time previously agreed between you and a Student, you agree to (i) immediately inform the Student that you are unable to provide your Teacher Services at the scheduled time, and provide the Student with an explanation; and (ii) immediately inform Learner’s Classroom admin. If you were unable to inform the Student in advance due to an emergency, you are required to give an explanation to the Student as soon as you are able to do so.

Except in the rare case of true emergencies, no Teacher Service (including a Lesson) may be cancelled or rescheduled by a Teacher within 24 hours of the start time for such Teacher Service.

2.4 Payment and Feedback

After you provide any Teacher Services, you agree to the following:

  1. Teachers are not allowed to ask students directly for the payment. All payments will be made to Learner’s Classroom by the students and Learner’s Classroom will be responsible for forwarding the payments to the specific teacher as per agreed norms.

  2. Teachers must confirm the receipt of payment from Learner’s Classroom prior to the initiation of any classes.

  3. Teachers must maintain reports for the timing and progress of each student and provide these reports to Learner’s Classroom on a weekly basis.

  4. Payments will be made every alternate Saturday to the trainers according to the number of classes conducted in the previous week(s).

  5. Payments will not be done in case of no shows of any student or in case of incomplete classes due to any reason.

2.5 Additional Guidelines

You also agree the following additional guidelines in connection with providing your Teacher Services on the Learner’s Classroom Platform:

  1. Maintain the privacy of Students pursuant to the Learner’s Classroom Privacy Policy, including refraining from requesting any personally identifiable information from Students, such as birth date, age, government issued identification number, phone number, or home address;

  2. Maintain the privacy of your own personal information

  3. Maintain records of all invoices and payments in connection with your Teacher Services;

  4. Cooperate with Learner’s Classroom in any anti-fraud actions and in resolving any disputes; and

  5. Report any violation of the Learner’s Classroom Terms or any other Learner’s Classroom Policies, including misuse of ratings and feedback.

2.6 No Discrimination.

Learner’s Classroom prohibits discrimination against students based on race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic that may be protected under applicable law. Such discrimination includes, but is not limited to, any refusal to provide services based on any of these characteristics. If it is found that you have violated this prohibition you will lose access to the Learner’s Classroom platform and your account shall be terminated.

3. Service Standards

3.1 Be Culturally Sensitive

Respect the values and traditions of your Students. Unless specifically requested by the Student, please avoid asking about the following:

  1. Your Student’s personal life. For example, do not ask a Student whether he or she is married, or whether he or she has a girlfriend or boyfriend.

  2. Your Student’s political affiliations. For example, do not ask a Student whether he or she supports a particular political party or ideological view.

  3. Your Student’s religious affiliations. For example, do not ask a Student if he or she believes in God or identifies with a particular religious group.

3.2 Be Patient and Polite

Since Students come from different backgrounds and have different language abilities, it is important to be patient and polite. Help them through their language learning difficulties. Be encouraging, not discouraging.

  1. Do not berate, yell at, or insult a Student. Do not tell a Student he or she is dumb or insult their current level of language ability.

  2. Do not use rude or offensive language with a Student. Instead, use respectful language and speak to Students with professional courtesy.

  3. Do not lose your temper with a Student.

If you are not sure whether you are able to handle a situation with composure, you are welcome to contact Learner’s Classroom customer service for help, or to suggest that a Student contact Learner’s Classroom customer service to resolve an issue.

3.3 Be Professional

Teachers must take the initiative in communicating with and managing Students. In addition to the Teacher Services guidelines described in Section 2 (Teacher Services Guidelines), Teachers are expected to provide Teacher Services in a professional manner, which includes:

  1. Being responsive. You should respond to messages from Students promptly. When you receive a demo class request from a Student, you should respond within 48 hours OR before the start time proposed by the Student for the Teacher Service (whichever is sooner). The Learner’s Classroom Platform will send you notifications when a Student sends you a message or a demo class request, but we recommend that you login to your Learner’s Classroom Account at least twice a day to check and respond to messages and Teacher Service requests.

  2. Actively manage your calendar and profile. Maintain your calendar to accurately reflect the times you are available to provide Teacher Services. When you login to your Learner’s Classroom Account, you should check and adjust your time availability schedule, and update your status. If you plan to take time off from providing Teacher Services, inform Learner’s Classroom admin and update your profile accordingly so that it is reflected in your calendar.

  3. Respect Student privacy. Recording audio or video of a Student is not permitted

  4. Teach your language. Students are paying you to teach them a new language. Do not use this time to practice the Student’s native language. Instead, give Students more speaking time.

  5. Provide accurate and respectful feedback. Learner’s Classroom provides a feedback and rating system to allow Students to publicly express their opinions to their Teacher’s instruction quality. Learner’s Classroom does not monitor, censor, or investigate feedback and rating posts unless a problem is brought to our attention. If you believe a particular Student’s feedback or rating is improper, untrue or violates Learner’s Classroom Terms or Learner’s Classroom Policies, please inform the incident to Learner’s Classroom customer service.

4. Violation of this Teacher Policy

You are expected to perform any Teacher Service in a manner that satisfies the teaching standards described above and results in a consistently high level of Student satisfaction. You are in breach of this Teacher Policy, if you:

  1. Fail to deliver any Teacher Service for which payment was accepted;

  2. Fail to take reasonable efforts to resolve a dispute with a Student;

  3. Create unacceptable levels of Student dissatisfaction; or

  4. Violate any Learner’s Classroom Terms or any other Learner’s Classroom Policies.

Learner’s Classroom reserves the right to take any of the following actions at any time and in its sole discretion:

  1. Cancel your listed Teacher Services;

  2. Limit your Learner’s Classroom Account privileges;

  3. Adjust your Teacher payment and/or freeze or suspend your payments;

  4. Suspend or terminate your Learner’s Classroom Account; or

  5. Contact law enforcement or seek legal remedies.

5. Teacher Content

The terms of this section regarding Teacher Content applies to all Teachers providing Teacher Services on the Learner’s Classroom Platform, in addition to Learner’s Classroom Terms.

5.1 Teacher Content Ownership

Any articles, videos or any other materials submitted to the Learner’s Classroom Platform in connection with your Teacher Services, such as your introduction video, constitute public Content. As a result, pursuant to this section, you do not own the copyright to the Content, and Learner’s Classroom is free to use the content for marketing activities without seeking any authorization from the teacher.

5.2 Student License to Teacher

You hereby grant each Student who purchases your Teacher Services a right to use, view and copy your Teacher Content that you use in providing your Teacher Services to such Student solely for personal and non-commercial educational purposes. You acknowledge that all of the representations, warranties, license grants and other provisions contained in Learner’s Classroom Terms apply to all of your Teacher Content that you share with students.

6. Prohibitions

In addition to complying with the restrictions regarding improper use of the Learner’s Classroom Platform as per Learner’s Classroom Terms, you agree not to, and will not assist, encourage, or enable Students or other Teachers to:

  1. Provide or post false, misleading, inaccurate, or plagiarized information on the Learner’s Classroom Platform, including in your Teacher profile, course content, lesson history and feedback.

  2. Fail to establish or maintain your Learner’s Classroom Teacher profile to ensure that it contains complete, accurate, and updated information.

  3. Provide your Teacher Services for free or in exchange for positive feedback or ratings from Students.

  4. Provide your Teacher Service, including offering and providing Lessons, to any "fake" Students that uses Learner’s Classroom Account created by yourself or any third party to drive up your lesson counts and ratings in bad faith.

  5. Forge or alter your education background, curriculum vitae, work experience or certificates.

  6. Advertise or promote third party language learning services.

  7. Encourage or allow Students to work with you outside of the Learner’s Classroom Platform or accept payment outside of the Learner’s Classroom Platform. If a Student asks you to provide Teacher Services outside of the Learner’s Classroom Platform, please remind the Student that lessons must be scheduled and paid for through the Learner’s Classroom Platform. You can report the Student or contact Learner’s Classroom customer support.

In the event that you violate the prohibitions set forth in this section, Learner’s Classroom reserves the right to immediately suspend or deactivate your Learner’s Classroom Account. Learner’s Classroom also reserves the right to confiscate any payments, and you may lose access to your lesson and teaching history on the Learner’s Classroom Platform. If you believe that others have violated these prohibitions, or if you are not sure whether any specific actions would violate these prohibitions, please contact Learner’s Classroom customer support immediately.

Payment Policy

This payment policy governs the Payment Services (as defined in the Learner’s Classroom Terms) provided by Learner’s Classroom to you.

 

1. Key Terms for Payment Services

"Lesson Fees" or "Package Fees" means the amounts that are due and payable by a Student for confirmed language lessons that are to be given by a Teacher. The Teacher alone, and not Learner’s Classroom, is responsible for setting the amount of the Lesson Fees or Package Fees.

"Commission Fees" means the fees Learner’s Classroom charges to the Teacher when using Learner’s Classroom platform Services.

"Payment Method" means a method or service available on the Learner’s Classroom Platform for a Student to purchase Language lessons and packages. Payments can be made using credit card, debit card, PayPal, or UPI using a 3rd party platform provided on Learner’s Classroom website.

2. Lesson Contract

Upon confirmation of Teacher Services, time, and price by both, the Student and the Teacher, such Student and Teacher shall be considered as entering into a contract, pursuant to which the Student agrees to purchase, and the Teacher agrees to deliver, the Teacher Services (the "Lesson Contract").

You agree not to enter into any contractual provisions that conflict with the Learner’s Classroom Terms or other Learner’s Classroom Policies. The Student and Teacher each covenant and agree to act with good faith and fair dealing in performance of the Lesson Contract. Furthermore, the Student and Teacher each acknowledge and agree that the value, reputation, and goodwill of the Learner’s Classroom Platform depends on their performance of the foregoing covenants and agreements. The Student and the Teacher therefore agree that Learner’s Classroom has the right to take such actions with respect to the Lesson Contract, including without limitation suspension, termination, or legal actions, as Learner’s Classroom in its sole discretion deems necessary to protect the value, reputation, and goodwill of the Learner’s Classroom Platform.

3. Financial Terms for Students

For Students, you must pay Learner’s Classroom to purchase Teacher Services from a Teacher.

3.1 Lesson payments

Learner’s Classroom charges students per lesson for the enrolled language course. Each course specifies the minimum number of lessons required for completing the course. Students are required to purchase the minimum number of lessons specified for the course.

Depending on the progress and learning capability of the student, additional lessons might be required for completion of the course as suggested by the trainer. Students would be required to purchase these additional lessons through the Learner’s Classroom platform.

3.2 Refunds on enrolled courses

No refunds will be given for purchased lessons. Learner’s Classroom will however consider special cases for refund based on exceptional circumstances. Learner’s Classroom is not liable for considering any such requests.

3.3 Payment Method Fees

When purchasing Learner’s Classroom lessons, you may be charged additional fees by the third party that provides the applicable Payment Method. These fees are not under Learner’s Classroom control, and Learner’s Classroom disclaims all liability in this regard. Whatever Payment Method you use may be subject to additional terms and conditions, which we recommend that you review before using such Payment Method.

3.4 Cancelled Lesson Requests

If a Lesson Request is cancelled by the Student, declined by the Teacher, or expires (not confirmed by the Teacher within the request period), the lesson will be rescheduled.

3.5 Confirmation of Lessons

The course will be scheduled by the trainer only after receipt of payment for the minimum number of lessons specified for the course.

3.6 Feedback and Ratings on course

As a Student, when you confirm a course was successful, you may be asked to leave feedback and a rating for the Teacher. Leaving feedback or a rating is optional. However, if you do so, you agree that your feedback must be genuine and honest, and will not commit fraud, spam, insult, harass, threaten, or otherwise misuse the feedback system.

You agree to report violations or abuses of our rating and feedback system by contacting Customer Service, and agree not to take any actions that undermine the integrity of the feedback system.

4. Financial Terms for Teachers

For Teachers, you must use Learner’s Classroom platform to receive payment for Teacher Services from Students.

4.1 Accepting Course Requests

Teachers will receive requests for courses from Students. By accepting a Course Request, you agree to provide the Lessons to the Student at the date and time as described in the applicable Course Request.

4.2 Cancellations of Course Requests

As a Teacher, you acknowledge and agree that Learner’s Classroom may in its sole discretion cancel a confirmed Lesson Request pursuant to Learner’s Classroom Terms and other Learner’s Classroom Policies. You further acknowledge and agree that Learner’s Classroom and the relevant Student will not have any liability for such cancellations or refunds.

4.3 Commission Fees

Learner’s Classroom collects commission fees for each course confirmed by the Student. For each successfully completed Lesson, Learner’s Classroom deducts a commission before forwarding the payment to the teacher.

To the extent any refunds that are issued to a Student, Learner’s Classroom would not be crediting the refunded amount to the teacher.

4.4 No Circumvention of Commission Fees

Teachers shall not to engage in any action or activity meant to circumvent the Commission Fees, with such actions or activities including, but not limited to, the following: (i) suggesting, soliciting, or accepting payment outside of the Learner’s Classroom Platform, or by other means other than through the Payment Services; or (ii) reporting or listing an inaccurate price for a Lesson on the Learner’s Classroom Platform, or charging a fee for a Lesson that is different from the amount agreed between Student and Teacher.

4.5 Withholding or Delaying Disbursement of Funds

If Learner’s Classroom determines that a Teacher's actions may have resulted or will result in a significant number of disputes, refunds or other claims from Students who purchased such Teacher’s Lessons, Learner’s Classroom reserves the right to delay or stop the disbursement of all funds accrued by the teacher. If Learner’s Classroom reasonably concludes that a Teacher has violated the Learner’s Classroom Terms or other Learner’s Classroom Policies, Learner’s Classroom may refuse to disburse the funds accrued by such Teacher.

5. Taxes

Teachers shall be solely responsible for determining their applicable tax related duties in connection with the income obtained from their Teacher Services, and shall also be solely responsible for remitting to the relevant authority any applicable taxes that need to be paid. Learner’s Classroom cannot and does not offer tax-related advice to any Members.

6. Prohibitions

In addition to complying with the restrictions regarding improper use of the Learner’s Classroom Platform described in Learner’s Classroom Terms, you understand and agree that you are solely responsible for compliance with any applicable laws, rules, regulations, and tax obligations that may apply to you in connection with the use of the Payment Services. In addition, you may not and you agree that you will not:

  1. Violate any local, state, provincial, national, or other law or regulation, or any order of a court, such as money laundering and internet fraud or theft;

  2. Use the Payment Services for any commercial or other purposes that are not expressly permitted by this Payment Policy;

  3. Use the Payment Services to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, personal contact information or credit, debit, calling card or account numbers, or photographs of others without their permission;

  4. Register any Payment Method or Withdrawal Method with your Learner’s Classroom account that is not yours or you do not have authorization to use;

  5. Attempt to probe, scan, or test the vulnerability of any Learner’s Classroom system or network or breach any security or authentication measures;

  6. Avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Learner’s Classroom or any other third party (including another Member) to protect the Payment Services;

  7. Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Payment Services to send altered, deceptive or false source-identifying information;

  8. Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Payment Services;

  9. Use credit cards or other payment methods fraudulently;

  10. Advocate, encourage, or assist any third party in doing any of the foregoing.

Learner’s Classroom has the right to investigate and prosecute violations of any of the above to the fullest extent of the law. In addition, and as set in this Payment Policy, Learner’s Classroom may take a range of actions against you, including but not limited to limiting access to your Learner’s Classroom Account and any associated Payment Services, for a violation of this Payment Policy.

7. Teacher – Student Dispute

In the event of a disagreement between a Teacher and a Student, Learner’s Classroom encourages the Teacher and Student to communicate directly and attempt to resolve the disagreement. If a Teacher and Student are unable to resolve a disagreement and Learner’s Classroom is asked to mediate, Learner’s Classroom may request that the Teacher and Student both provide communication records regarding the dispute, which should show all key relevant information including the time, date and communication details. Although Learner’s Classroom will attempt to evaluate the dispute on an impartial basis, Learner’s Classroom will have the authority to resolve the dispute in its sole discretion, and Learner’s Classroom resolution of the dispute will be final. As a result, Learner’s Classroom shall have the right, in its sole discretion:

  1. To transfer or offer a refund, or reverse a transaction.

  2. To designate who shall bear any Fee resulting from any such actions.

We consider this as our fundamental duty to safeguard your credentials like name, email ID, payment details, contact number, transaction details, etc. Whether you are browsing through the Learner's Classroom website or making any payment with us, everything happens under a secured ecosystem. Our policy and procedures have been robustly designed which prevents any information from leaking to anyone else. Here are the pointers that we strongly follow:

  • All your transactions with Learner's Classroom are done safely
  • We never disclose student’s information to anyone.
  • We never disclose trainer's information to anyone.
  • We accept payments by RazorPay as it is one of the most authenticated ways to conduct payments.
  • After signing up with us you will be receiving emails to update you regarding the latest services.
  • Your personal information like email IDs, contact numbers, transaction details are secured in an encrypted database and we never share it with anyone.
  • Learner's Classroom reserves the right to edit, add or modify the privacy and policy. Whenever we do it, you will receive an email from us regarding the same.

Student Policy

 

1. CONTRACTUAL RELATIONSHIP

These Terms of Use ("Terms") govern the access or use by you, an individual (“Student”), of applications, websites, content, products, and services (“Services”) made available by Learner’s Classroom, a company established in India. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Learner’s Classroom. If you do not agree to these Terms, you may not access or use the Services.

Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services.

Learner’s Classroom may restrict you from accessing or using the Services, or any part of them, immediately, without notice, in circumstances where Learner’s Classroom reasonably suspects that:

  • You have, or are likely to, breach these Terms; and/or

  • You do not, or are likely not to, qualify, under applicable law or the standards and policies of Learner’s Classroom and its affiliates, to access and use the Services.

MODIFICATIONS TO TERMS OF USE AND/OR PRIVACY POLICY

Learner’s Classroom reserves the right, in its sole discretion, to change, modify, or otherwise amend the Terms, and any other documents incorporated by reference herein for complying with legal and regulatory framework and for other legitimate business purposes, at any time, and Learner’s Classroom will publish the amended Terms at the domain of www.Learnersclassroom.com/terms. It is your responsibility to review the Terms of Use for any changes and you are encouraged to check the Terms of Use frequently.

PRIVACY POLICY

Learner’s Classroom has established a Privacy Policy that explains to users how their personal information is collected and used. The Privacy Policy is located at: Privacy Policy.

Learner’s Classroom shall not be responsible for any breach of privacy policy by the third party contractor for information shared between you and the third party contractor.

 

2. THE SERVICES

Learner’s Classroom will provide the Services to you under this Agreement. The Services constitute the provision of a technology platform that enables you, a user of Learner’s Classroom Website to: (a) arrange and schedule services with independent third party providers of those services, who have an agreement with Learner’s Classroom and (b) facilitate payments to Third Party Providers through the platform for the services and receive receipts for those payments.

The Services are made available solely for your personal, non-commercial use, unless Learner’s Classroom has agreed with you otherwise in a separate agreement. You acknowledge that Learner’s Classroom does not provide these services and that all such services are provided by independent third party contractors who are not employed by Learner’s Classroom or any of its affiliates. Learner’s Classroom accepts liability for the Services on its Platform that it provides to you subject to these Terms. Third Party Providers are responsible for the services they provide to you.

License

Subject to your compliance with these Terms, Learner’s Classroom grants you a limited, non-exclusive, non-sub-licensable, revocable, non-transferable license to: (i) access and use the Learner’s Classroom Platform on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, non-commercial use. Any right not expressly granted herein are reserved by Learner’s Classroom.

Under this license, you are allowed to access and reproduce any teaching material provided during the lessons only for personal and non-commercial purposes.

Restrictions

You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Learner’s Classroom; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

Ownership

The Services and all rights therein are and shall remain Learner’s Classroom property. Neither these Terms nor your use of the Services convey or grant to you any rights: (i) in or related to the Services except for the limited license granted above; or (ii) to use or reference in any manner Learner’s Classroom company names, logos, product and service names, trademarks or services marks or those of Learner’s Classroom licensors.

 

3. YOUR USE OF THE SERVICES

User Accounts

In order to use most aspects of the Services, you must register for and maintain an active personal user Services account ("Account"). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account, unless a specific Service permits otherwise. Account registration requires you to submit to Learner’s Classroom certain personal information, such as your name, address, email address, mobile phone number and age.

You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by Learner’s Classroom in writing, you may only possess one Account.

User Requirements and Conduct

You may not authorize third parties to use your Account. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when accessing or using the Services, and you may only access or use the Services for lawful purposes. You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage, whether to the Third Party Provider or any other party. In certain instances you may be asked to provide proof of identity or other method of identity verification to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity or other method of identity verification.

By enrolling in a course provided at Learner’s Classroom platform, you are responsible for having access to an environment conducive to learning which includes suitable internet connectivity, a working device and a quiet space.

Learner’s Classroom creates an inclusive learning environment for both teacher and student. As a student you are required to be respectful towards your teachers and your peers. You are also mandated to comply by the Code of Conduct policy available at www.learnersclassroom.com/terms. You shall not behave inappropriately during the lessons. In particular you are not allowed to record any videos of the lessons or share any personal information of the teacher. You are expected to be culturally sensitive to other members on the Learner’s Classroom platform. Avoid asking about the following:

  1. Other member’s personal lives. For example, do not ask a Student or a teacher whether he or she is married, or whether he or she has a girlfriend or boyfriend.

  2. Other member’s political affiliations. For example, do not ask a Student or a teacher whether he or she supports a particular political party or ideological view.

  3. Other member’s religious affiliations. For example, do not ask a Student or a teacher if he or she believes in God or identifies with a particular religious group.

Learner’s Classroom is not liable for breach of privacy terms by third party contractors. Students are therefore responsible for maintaining their privacy by not sharing any personal information with third party contractors (Teachers) or other students.

No Discrimination

Learner’s Classroom prohibits discrimination against Third Party Providers based on race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic that may be protected under applicable law. Such discrimination includes, but is not limited to, any refusal to accept services based on any of these characteristics. If it is found that you have violated this prohibition you will lose access to the Learner’s Classroom platform.

User Provided Content

Learner’s Classroom may, in its sole discretion, permit you from time to time to submit, upload, publish or otherwise make available textual, audio, and/or visual content and information, including commentary and feedback related to the Services, initiation of support requests, and submission of entries for feedback, competitions and promotions ("User Content").

By providing User Content to Learner’s Classroom, you grant Learner’s Classroom a worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works of, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and Learner’s Classroom business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

You agree to not provide User Content that is defamatory, grossly harmful, blasphemous, paedophilic, invasive of another’s privacy, ethnically objectionable, disparaging, relating or encouraging money laundering of gambling, libellous, hateful, racist, violent, obscene, pornographic, unlawful, or otherwise offensive, as determined by Learner’s Classroom in its sole discretion, whether or not such material may be protected by law. Learner’s Classroom may, but shall not be obligated to, review, monitor, or remove User Content, at Learner’s Classroom sole discretion and at any time and for any reason, without notice to you.

Violation and Termination

Learner’s Classroom may, in its sole discretion, terminate a user account for breach of code of conduct or violation of student policy. In such a case, Learner’s Classroom is not obligated to (i) provide refund to a user for an enrolled course or (ii) provide the remaining lessons / services for the enrolled course.

 

4. PAYMENT

You understand that use of the Services may result in charges to you for the services you receive from a Third Party Provider ("Charges"). At the time of enrolment, Learner’s Classroom will facilitate your payment of the applicable Charges on behalf of the Third Party Provider as such Third Party Provider’s limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Third Party Provider. All payments must be made using the Learner’s Classroom payment gateway and Third party providers are not authorized to collect any payments directly.

All payments will be received in INR (Indian rupees) through Learner’s Classroom payment gateway and any additional transaction fee, exchange rate and taxes will be borne by the payee.

Learner’s Classroom may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you.

Each course indicates a minimum lesson requirement for its completion. At the time of enrolment to a course, you are required to pay for the minimum stipulated lessons. Any additional lessons will be charged separately based on an understanding between the teacher and the student. No refunds will be processed after enrolment in the course. Special requests for refund might be considered based on the discretion of Learner’s Classroom. Before enrolment to a course, students can enrol for a paid demo class. Only one demo class can be availed per course. The fee for the demo class is indicated on the website along the profile of the teacher which needs to be paid in advance.

If you are unable to attend a lesson previously agreed between you and a Teacher, you agree to (i) immediately inform the Teacher that you are unable to attend the lesson at the scheduled time, and provide the Teacher with an explanation; and (ii) immediately inform Learner’s Classroom admin. If you were unable to inform the Teacher in advance due to an emergency, you are required to give an explanation to the Teacher as soon as you are able to do so.

Except in the rare case of true emergencies, no Lesson may be cancelled or rescheduled by a Student within 24 hours of the start time for such a lesson. In the case of a student not informing the Teacher or Learner’s Classroom admin 24 hours prior to the scheduled lesson, the lesson would be counted as attended and no extra lesson would be provided as a replacement for the no-show lesson.

 

5. Indemnity

You agree to indemnify and hold Learner’s Classroom and their officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (i) your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Learner’s Classroom use of your User Content; or (iv) your violation of the rights of any third party, including Third Party Providers ("Losses ").

Code of Conduct

In order to ensure that the Learner’s Classroom Platform is a safe place where language learners can avail commercial services from language teachers, all Members must read and agree to be bound by the code of conduct.

 

Conduct and Content Policy

In addition to Learner’s Classroom Terms, Learner’s Classroom does not tolerate any of the behaviors described below:

  1. Spam: Do not send non-relevant message to Members of the Learner’s Classroom Platform.

  2. Commercial Advertisements: Do not contact other Members for commercial purposes without their consent. In addition, do not create posts or comments that are solely for commercial purposes since this detracts from, and does not add anything of value to, the language-learning community.

  3. Search for a Romantic Relationship: Do not contact other Learner’s Classroom Members for dating, or to find sexual partners. This is improper conduct, and will be treated as harassment.

  4. Harassment, Bullying, or Stalking: Learner’s Classroom does not tolerate harassment, bullying or stalking. Learner’s Classroom may, at its sole discretion, take action on the reports of harassment, bullying and stalking. Repeatedly messaging another user with unwanted friend requests or messages is harassment.

  5. Impersonation: Do not claim to be another person, or seek to mislead others as to your identity by copying another Member’s avatar, using a username that is misleadingly similar to another Member or otherwise posing as another Member. Do not create a false presence for an organization.

  6. Personal Information of Others: Do not post on the Learner’s Classroom Platform other people’s personal information, such as phone number, private email address, physical address, credit card number, passwords and/or any other similar personal identifiable information.

  7. Threat of Violence: Do not threaten violence towards other people, or use the Learner’s Classroom Platform to organize, promote, or incite acts of real-world violence or terrorism.

  8. Hate Speech and Offensive Language: Do not post any content, send any messages or otherwise take any actions on the Learner’s Classroom Platform that attacks others based on their body size, personal appearance, level of experience, race, ethnicity, nationality, religion, gender, sexual orientation, disability or medical condition.

  9. Sexually Obscene Content: Do not post any pornographic content, any sexually explicit content or any content that display nudity.

  10. Pirated Content: Do not post any content that infringes any third party’s intellectual property rights.

  11. Self-Harm: Do not post any content that promotes or encourages self-harm such as self-mutilation, eating disorders, drug abuse or suicide.

  12. Defamation: Do not post any content on the Learner’s Classroom Platform that is intended to, or would reasonably be expected to, harm Learner’s Classroom or our brand, including the images and reputations of our employees, agents, and officers.

  13. Political or Religious Discussions: Do not initiate or participate in discussions or post images that relate to political or religious events or groups. Politics and religion are sensitive topics that often lead to polarizing and hateful comments. It is our position to not have these types of discussions on a site that is meant for language learning.

Reporting Violations

We rely on Members to let us know when violations of the Code of Conduct Policy occur. We do not actively monitor the Learner’s Classroom Platform for offensive content or other violations of this Community Policy.

If you believe that a violation of this Learner’s Classroom CoC Policy or other Learner’s Classroom Policies has occurred, please report the violation to contact@learnerclassroom.com

Actions we may take in response to a violation of this CoC Policy include but are not limited to:

  • Remove the violating content;

  • Suspend the Learner’s Classroom Account of the Member that committed the violation; and/or

  • Terminate the Learner’s Classroom Account of the Member that committed the violation
